  1. Rep. Connick's HB389 and his amendments do not allocate funds or otherwise provide for medical monitoring, but states that any BP release a claimant signs may not prohibit medical monitoring. In other words, the claimant, by signing a release, cannot be precluded from filing claims against BP for health problems related to exposures to the oil, dispersants, etc.

    "B. Any settlements and releases associated with the BP Oil Spill which occurred on April 20, 2010, shall contain a provision advising the releasor that the release does not prohibit the releasor from receiving medical monitoring and other procedures as provided in 29 CFR 1910.1028, if the releasor participated in the clean-up, dispersal, burning, containment, or decontamination of the spill, leaks, ruptures, or solid residues, or has been exposed to crude oil components or dispersants and whose respiratory exposure protection was not in accordance with 29 CFR 1910.1028 or 1910.134, or has sustained dermal exposure through direct skin contact with crude oil contaminants or dispersed or emulsified crude oil residues sufficient to produce exposure equal to or above the action level as provided in 29 CFR 1910.1028."
